Terms and Conditions (T&C)

Legal Notice / Imprint

Note: These T&C apply to consumers (Section 13 BGB) and business customers (Section 14 BGB) in Italy, Germany, and Austria. Deviating customer terms apply only if we have expressly agreed to them.

1. Scope & Contract Language

1. These T&C apply to all contracts concluded via our online shop as well as by telephone or email.
2. The contract language is German. Applicable law: see section 15.

2. Offer, Product Representations & Printing Particularities

1. Product images are non-binding. Colour and brightness variations between screen and print are technically unavoidable and do not constitute a defect.
2. Canvases are handmade; minor dimensional and cutting tolerances are common in the trade.
3. For custom designs (uploading own motifs, layout requests), your final approval (e.g. print proof) is binding.

3. Conclusion of Contract

1. By submitting your order, you make a binding offer. You will first receive an automatic order confirmation (not an acceptance).
2. The contract is concluded through our express acceptance (separate email) or upon dispatch of the goods.

4. Prices, Shipping Costs & Payment

1. All prices in EUR include statutory VAT, plus any applicable shipping costs.
2. We reserve the right to exclude certain payment methods.
3. For prepayment, production starts after payment has been received.
4. Vouchers/credits are not redeemable for cash; remaining balances remain usable until the expiry date.

5. Production, Delivery Time & Shipping

1. Production time: approx. 7–14 working days after approval or payment receipt for custom products.
2. Delivery to Italy, Germany, and Austria: shipping time approx. 7–30 working days. Total delivery time = production + shipping.
3. Partial deliveries are permissible if reasonable.
4. B2B: Risk passes upon handover to the carrier. Consumers: Risk passes upon delivery to you.
5. Please report transport damage to us and the carrier immediately; visible damage should be noted upon receipt if possible.

6. Retention of Title

1. Goods remain our property until payment has been made in full.

7. Image Rights, Content & Indemnification

1. By uploading motifs, you confirm that you hold all necessary rights (copyright/related rights/trademark/personal rights).
2. You grant us a simple licence necessary to perform the contract.
3. Unlawful, discriminatory, pornographic, or criminal content will be rejected.
4. You indemnify us from third-party claims arising from violations of the above warranties.

8. Print Data & Quality Requirements

1. Recommended: resolution ≥ 150–300 dpi at final size; formats: JPG/PNG/PDF; colour profile: sRGB.
2. Edge wrap: please allow 3–5 cm bleed all around; keep important elements away from the edge.
3. We do not check data for content/spelling errors. An optional preflight check can be booked for an additional fee.

9. Right of Withdrawal

1. Information on the right of withdrawal can be found here: https://canvasvision.it/right-of-withdrawal.
2. Note: For custom-made goods, the statutory right of withdrawal may be excluded (Section 312g para. 2 no. 1 BGB).

10. Warranty & Liability

1. Statutory warranty rights apply. For B2B customers, the limitation period is 12 months from transfer of risk.
2. Liability for intent and gross negligence is unlimited. In cases of slight negligence, we are liable only for breach of essential contractual obligations and limited to foreseeable, typical damage.
3. Liability for injury to life, body, or health, as well as under product liability law, remains unaffected.

11. Assembly, Use & Care

1. Check wall conditions on site; use suitable dowels/screws depending on the wall material.
2. Clean only dry/dust-free; do not use aggressive cleaners or moisture on the canvas surface.

12. Rights of Retention & Set-off

1. Rights of retention exist only from the same contractual relationship. Set-off only with undisputed or legally established claims.

13. Storage of Contract Text

1. We do not permanently store the contract text in a publicly accessible form. Order data and these T&C will be sent by email. You can view past orders in your customer account (if available).

14. Alternative Dispute Resolution

1. The EU Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr.
2. We are not obliged or willing to participate in dispute resolution procedures before a consumer arbitration board.

15. Applicable Law & Jurisdiction

1. Italian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only if no mandatory consumer protection provisions of their home country are removed.
2. If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction is Bolzano, Italy.

16. Changes to the T&C

1. We may amend these T&C with effect for the future if there are valid reasons (e.g. legal changes, expansion of our offer). We will inform you of changes in good time.

17. Severability Clause

1. Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply instead of the invalid provision.
